LICENSING INFORMATION

Guardian Insurance Limited (trading as Guardian Insure, and referred to as such hereafter), FSP number 1009528, holds a licence issued by the Financial Markets Authority to provide financial advice. Guardian Insure is authorised by that licence to provide advice.

NATURE AND SCOPE OF ADVICE

Guardian Insure provides advice to our retail clients about their personal insurances and their KiwiSaver. Our Financial Advisers provide financial advice in relation to these financial advice products.

We only provide financial advice about products from certain providers, which are listed in our Disclosure Guides. We have a separate Disclosure Guide for insurance advice and for KiwiSaver advice, and you will be given the one that applies to you before we provide advice.

The information below will help you understand what type of advice we can provide to you.

For insurance:

  • We will provide advice tailored to your specific financial needs, objectives, and circumstances, as determined through a comprehensive consultation and needs analysis.

  • We will help you choose and apply for cover that is suitable for your goals and circumstances.

  • We have access to a range of insurers.

  • Once we have chosen an insurer, and types and amounts of cover that are suitable to you, we will help you to obtain acceptance.

  • We may also be able to help you maintain your insurance policy, for example if there are changes in your circumstances requiring changes to the cover.

Below are the types of insurance products we can assist with:

  • Life Insurance

  • Trauma Insurance

  • Total and Permanent Disability Insurance

  • Mortgage Repayment Insurance

  • Income Protection Insurance

  • Key Person Insurance

  • Health/Medical Insurance

  • Specific Injury Cover

  • We will provide advice tailored to your specific financial needs, objectives, and circumstances, as determined through a comprehensive consultation and needs analysis.

  • We will help you choose a KiwiSaver scheme and fund that is suitable for your goals, your timeframe, and your comfort with risk.

  • We have access to a range of KiwiSaver scheme providers.

  • Once we have chosen a scheme and fund that is suitable to you, we will help you join or transfer.

  • We may also be able to help you maintain your KiwiSaver, for example if your income, timeframe or plans for the money change.

Below are the types of KiwiSaver advice we can assist with:

  • Joining KiwiSaver

  • Choosing a KiwiSaver scheme provider

  • Choosing a fund within that scheme

  • Your contribution rate

  • Confirming your Prescribed Investor Rate (PIR)

  • Using your KiwiSaver towards a first home deposit

  • Using your KiwiSaver to fund your retirement, including how you draw on it

We source KiwiSaver schemes from a panel of providers, which is listed in our KiwiSaver Disclosure Guide. There are other KiwiSaver schemes available in New Zealand that may also suit your needs. Our advice is limited to the schemes on our panel, and to the funds within those schemes that Guardian Insure has approved. We review this panel at least annually.

KiwiSaver is an investment. Returns are not guaranteed, the value of your balance can go down as well as up, and you may get back less than has been contributed.

Referrals

We may also refer you to other specialists at your request, including mortgage advisers, legal professionals, general insurance advisers, and investment specialists for investments other than KiwiSaver. We are not able to give advice on the products our referral partners offer.

We may receive a referral fee for doing so which will be outlined in your statement of advice when the specific referral case is known.

FEES AND EXPENSES

Insurance

You will not be charged a fee for the insurance advice we provide to you if you proceed with a policy on our recommendation. This is possible because, on issuance of an insurance policy, the insurer usually pays commission to us.

There is one exception. If you ask us to provide financial advice and we do not receive a commission from the insurer, we may charge you a one-off fee. Any such fee would be agreed and authorised by you in writing before we complete the services, and would be based on an estimate of the time spent providing the advice. This may arise in the rare event that you ask us to advise on a product offered by an insurer that is not on our panel of approved insurers, or on an insurance that is outside our usual arrangements with our approved insurers.

KiwiSaver

How we are paid for KiwiSaver advice depends on the scheme.

Paid by the scheme provider. In most cases the provider pays us out of the fees it already charges you for managing your KiwiSaver. Nothing extra is deducted from your account and you pay nothing separately to us. This can be a one-off payment when you join or transfer, an ongoing payment each year based on your balance, or both.

Charged to your KiwiSaver account. For some schemes, an advice and service fee is instead deducted from your KiwiSaver account and paid to us, which reduces your balance. Where this applies, Guardian Insure charges between 20 and 50 basis points (0.20% to 0.50%) per year of your balance, and one scheme also has a one-off initial advice fee of up to $150 when you join. Some providers rebate part of their own management fee back to your account where an advice fee is being charged.

For some schemes on our panel both apply at once: the provider pays us a set amount, and we can choose to charge a further advice fee to your account on top of it. Where that is the case, we will show the two amounts separately.

We will tell you which of these applies to your scheme, and the exact amounts, in your Statement of Advice before you decide whether to proceed.

In addition to anything paid to us, you will pay fees to your KiwiSaver scheme provider. These are charged as a percentage of your balance each year and are deducted from your account. The fees for your current fund and for any fund we recommend will be set out in your Statement of Advice, in both dollars and as a percentage, and in full in the provider's Product Disclosure Statement.

COMMISSIONS AND INCENTIVES

Insurance

On acceptance of an insurance application by the insurer, the applicable insurer usually provides us with a commission payment. The commission is generally an upfront commission payment, but an ongoing commission payment may also be paid by the insurer. The upfront commission is calculated as a percentage of the first year's premium that you will pay. An ongoing commission is calculated as a percentage of the premium that you pay for each year the policy is in force.

Across our panel of insurers, upfront commission ranges from 70% to 230% of the first year's premium, and ongoing commission ranges from 5% to 8% of the premium each year. The rates for each insurer are set out in our Disclosure Guide, and the amount that applies to your policy will be confirmed in your Statement of Advice.

KiwiSaver

Where a scheme provider pays us a commission, it is generally made up of an upfront payment when you join or transfer, and an ongoing payment calculated as a percentage of your account balance each year for as long as you remain in the scheme.

Across our panel of KiwiSaver providers, upfront payments range from $50 to $400 per member. The amount depends on the provider, and for some providers on your income and the balance you transfer. Not every provider pays an upfront amount, and some upfront payments are conditional, for example on your balance exceeding a set amount or on how your money is spread across fund managers.

Ongoing payments to us range from 0.20% to 0.50% per year of your account balance, whether paid to us by the provider or charged to your account as described above.

Some providers require us to repay an upfront payment if you leave the scheme within a set period after joining. This costs you nothing, but you should know it exists, because it gives us a financial interest in you remaining with that scheme. If we recommend that you move, we will explain why the move is in your interest regardless of that.

The amounts for each provider are set out in our KiwiSaver Disclosure Guide, and the amounts that apply to you will be confirmed in your Statement of Advice.

Both

You will receive further detail when the nature and scope of the work we undertake for you is known, and again in your Statement of Advice.

We may also receive a referral fee or commission payment if we refer you to one of our referral partners. These are set out in our Disclosure Guides.

CONFLICTS OF INTEREST

To ensure that our financial advisers prioritise our clients' interests above their own, we follow an advice process that ensures our recommendations are made on the basis of each client's goals and circumstances. All our financial advisers undergo annual training about how to manage conflicts of interest. We maintain registers of conflicts of interest, and of the gifts and incentives we receive.

Our insurance partners and KiwiSaver scheme providers will provide us commissions and, from time to time, gifts such as event tickets and dinners.

We manage the resulting conflict of interest by ensuring our advisers only recommend products where the adviser is satisfied that those products provide the best outcome for our clients, when compared with any other product we are able to recommend, having regard to the nature and scope of the service agreed with the client.

For KiwiSaver specifically, we are paid either by the scheme provider or by an advice fee charged to your KiwiSaver account, and the amounts differ between providers. We manage this by setting out in your Statement of Advice the fees you currently pay and the fees you would pay under our recommendation, in both dollars and as a percentage, and by explaining in writing why any recommendation that costs you more is still in your interest.
